of the 30th. January, 1904, to the stipulation that the

Admiralty should be allowed to utilize the red area as

necessary thereby tacitly consented to its use for other

purposes than for a Hospital. The local correspondence

plainly shows that the land was required for a Hospital,

and it was not apprehended that the words "use it as neces-

-sary" in Commodore Robinson's letter of the 3rd. December,

1903, were meant to imply that the Naval Authorities wished

to utilize the land for other purposes.

I am, however, prepared to agree

to the addition of the words "without the express consent

of the Colonial Government" to Clause 5 of the Memorandum

which should satisfy the requirements of the Admiralty and

at the same time ensure that the land is not utilized for

a purpose objectionable to this Government.

I shall be glad to learn whether

the Admiralty agree to the clause being amended according-

-ly.
